Innovativa ed originale sentenza del Giudice di Pace di Foggia che, facendo proprio un recentissimo orientamento della Suprema Corte di Cassazione, decide di condannare uno spericolato giovane “centauro”, reo di aver investito con la propria moto un small dog breed "Yorkshire", following a high speed ring in the city, to pay the so-called "moral damage" in addition to the amount necessary to compensate the economic loss suffered by the owner of the unfortunate pet.
The facts, the subject of litigation, dating back about two years ago. A motorcyclist
Foggia, going at high speed arterial road on the outskirts of Foggia, defined as "expressway" for free for a long stretch of intersections and traffic lights, had hit his vehicle with an unfortunate small yorkshire, escaped a fraction of a second testing of rightful owner.
Following this unfortunate event, the owner had sought, unsuccessfully, to the young rider to pay a sum of one thousand euro, which includes both the economic damage suffered as a result of losing their dog "pure bred", and for pain and suffering emotional consequence of the death of his faithful pet.
Hence the decision came in contact, through counsel, the Justice of Peace of Foggia.
dauno The magistrate discharged by means of a technical consultant, the real "market value" of the breed in question, decided to settle "on an equitable basis" (as the demand for damages did not exceed the total value of € eleven hundred), not only damage for the economic damage suffered by the owner of the small Yorkshire (estimated at four hundred euro), but also the moral damage on the emotional injury suffered by pet owner, calculated and estimated in the sum of three hundred euro.
foggiano The young rider had opposed the request in court ordering the payment of compensation for moral damages claiming, through their attorney, incompatibility of such a request with the lack of foresight on the legislation, to be precise, hypothesis of the death of the animal. The injury suffered by the loss of an animal, a lesion affecting the relationship between man and the animal does not fall, in fact, as laid down by 'Article 2059 of the Civil Code relating to non-pecuniary damage.
Justices of the Peace of Foggia did not intend, however, to listen to the reasons for the young rider stating in its decision that "... just as he recently supported the Supreme Court in its Judgement No 4493 February 25, 2009, regarding the Recoverability of morality, it must be reiterated that in the opinion of the fairness of the justice of the peace, coming in relief and educational equity or replacement of the rule of substantive law, not by limiting the damages not only to capital cases determined by law, established by art. 2059 Civil Code, even if constitutionally correct interpretation of that provision. It follows that the magistrate, in the only court of equity may order compensation for non-pecuniary damage outside of the cases determined by law and those relating to the infringement of constitutionally protected values \u200b\u200bof the human person, provided that the victim's attachment and tried (through assumptions) the injury suffered, being excluded from the non-pecuniary damage represents an automatic consequence of the offense. "
Even the loss of an animal may therefore be due to compensation danno morale, quale voce del danno non patrimoniale. Tutto questo però solamente qualora il valore complessivo della richiesta risarcitoria non superi il limite di euro millecento, al di sopra del quale il Giudice di Pace, eventualmente chiamato a decidere, non potrà fare a meno che applicare “rigidamente”, e non più “secondo equità”, le norme di diritto del nostro ordinamento, che non prevedono ,purtroppo, la liquidazione del danno affettivo sofferto dal proprietario di un animale per la sua perdita!
Nel caso in esame il Giudice di Pace di Foggia ha, invece, con coraggio, deciso di “valutare con equità” , e quindi “secondo coerenza e criteri di giustizia generale”, submitted to the episode, widely accepted as proved in court the emotional injury reported by the owner of the small and unfortunate yorkshire, following his death caused by reckless young centaur.
